Mumbai Court to formally announce on October 20, the bail plea of Aryan Khan

The investigations are still in process.The court is still not ready with its final statement as to they'll grant bail to Aryan Khan or not.Recently his bail plea was unheard.The NCB recorded the statement of each and every person present there the eight people were alleged under the NDPS Act (Narcotic Drugs and Psychotropic Substances Act).

Aryan Khan and two others were alleged on 2 of October evening for inclusion in utilization, selling and buying of booty. On Monday a bail hearing was done in the Mumbai High Court extended the NCB custody of Aryan Khan and others till October 7. The court order stated that,"I am of the view that investigation is of prime importance. Considering this aspect that the presence of the accused with NCB is necessary, the custody has been extended till October 7."

Aryan Khan's Lawyer Satish Maneshinde in his defence contended that nothing was recuperated from Aryan Khan and requested that the court to grant bail. The NCB, then again, contended that the investigation is still in progress and the ongoing custody of Aryan Khan for additional test.Further his lawyer said Aryan Khan doesn't need to sell drugs on a ship. If he wants he can buy the whole ship. Aryan during his defense in the court said that I don't have any criminal tendencies If I had or If was the culprit I would have ran away rather than letting you check upon me. Aryan Khan's Lawyer stated, " Mere chatting on the phone without corroboration, doesn't make an offence."

The lawyer argues at the court assembly and says Why they are not granting him bail and even if the case is non- bailable, there has to be facts and evidence to proof it. Based on the "incriminating evidences" found through WhatsApp and links to "international drug racket" he said “They are levelling very serious allegations against Khan. But it has to be supported with evidence… The court can look through the chats… They do not talk about it.”

Senior Advocate Amit Desai praised the efforts taken by NCB officers as they investigate the case minutely and go through each and every aspect. He said "Kudos to the NCB for doing this job and I just hope that they continue investigation in a legal manner."

He further talked about equality and said "I stand before the Court and urge your lordships to follow the law. No celebrity or role model enjoys special status before the Court, and hence they should be treated equally before law.""There has to be a separate memo for that. We have forgotten these things. Nobody stops their investigation, why should it stop my liberty? It stops at liberty, liberty and liberty!"

He said till the crime is not justified you can't lock anyone up "They say that you are a person at the bottom of the chain, that you are the consumer, and instead of trying to reform you, I will pick you up and put you in jail, till the time the conspiracy is unearthed."

Talking about the WhatsApp chats he said a thorough investigation should have been done "The language (in the chats) may seems like something different than what ought to be in a court of law. And those conversations may lead to suspicion, as it should. But what is important to be borne in mind is by no stretch of imagination is this boy involved in any kind of conversation of drug trafficking or internal drug trafficking."

Coming to the fact he said "The fundamental argument is that there was a rave party. I was not found with anything. I cannot be held responsible. There is nothing on the phone about the messages about rave party."Desai said that Khan was not even on the cruise ship and that there was no recovery of any banned substance from him. He also pointed out that the claims of international trafficking and conspiracy in NCB's reply were not attributed to any of the accused specifically. Chief Metropolitan Magistrate RM Nerlikar rejected the bail application.The case was forwarded to the special court which was under NDPS Act.
